They were prepared for Action4Canada, so I would suspect they were prepared by Rocco Galati. However, why do you need to know if they work. You know what works? You standing up and saying hell no to all of it. These are a tool to be mixed with your relentless anger directed at people that think they have the right to tell you what to do with your body, and punish you for not following their orders.
These forms need to be updated now that Health Canada “approved” Moderna. It is no longer just approved for emergency use. Right.

And the frustrating thing is is it is not lawful. you can try to inform them that this is not lawful, but the challenge is that businesses and people seem to think the government is all powerful and can do whatever they want, they don’t understand that it is simply not true. I will have to adapt it to an American version.
I have informed my employer about my refusal to get tested as I stated there could be a high probability of being swabbed with something that had been soaked in a very carcinogenic substance (ethylene oxide). I also had previously refused to wear a mask to return to work. That’s how I ended up getting told to leave and not return till I tested negative. I didn’t hesitate or give an inch in my refusal to comply. No second thoughts and no regrets in protecting freedom. I believe the effect of “tolerance” is cumulative and operates asymptotically towards “acceptance”.
I am posturing in a lo profile initially to see what their policies are, in writing if I can, but I think I will soon be be submitting not only both of the forms on your site (modified), but also from Children’s Health Defesnse Fund and others sources if needed.

I think you are missing the point. You sign them, and serve them to your employer. Let them have the information, and then see what they do. Most will back off right away, when reviewing the information in the document. If they don’t, you simply tell them, this is a slam dunk case for a lawyer, considering these vaccines are in experimental use only. There is no legal way anyone on this planet in ANY COUNTRY can make you take these. It violates international law.
Now I feel stupid because I sent it to my university principle without realizing I’m to fill out the blank lines with my name, date and signature. I gave him a blank copy. A lot of good that will do. I think I was so traumatized by the whole mandating thing it went over my head. I worked so hard and am almost finished my BA degree, with a scholarship. If I quit, I lose my scholarship and won’t have the funds to pay for housing. I’m devastated.

The university of toronto just mandated vaccinnes. The employer has emailed saying you cannot be a bus driver for U of T without both shots. Say fuck no. Unify with the people that don’t want to get vaxxed, and go to them with the threat of suing them into oblivion. As a lawyer in Canada, I can confirm there is no case to sue anyone into oblivion over COVID19 vaccines… At most, you’d have a claim for constructive dismissal and severance pay in employment law, among other things. But no remedy under tort law (suing people)…the pandemic qualifies as a novel situation. The courts will apply the Annes Cooper test and the government and private organizations would ultimately escape liability under stage 2 where residual policy considerations would restrict or extinguish the duty owed to this indiscriminate class (anti-vaxxers) of people. Not to mention that the courts won’t recognize a DOC that would give rise to indeterminate liability to an indeterminate class and create an unintended insurance scheme. Its also worth noting that “Core” policy govt decisions protected from suit are decisions as to a course or principle of action that are based on public policy considerations like economic, social, and political factors provided they’re not irrational nor taken in bad faith; there is considerable support in jurisprudence that these policy decisions should be protected from negligence liability…

These forms are great but in my situation I was told it was mandatory to have a vaccine after our summer shutdown for me to be able to come back to work. I called the ministry of labor and they said they could do nothing. They said it was up to the individual business to decide what they see as safe. They said I could retain a lawyer at my own expense but I am not willing to bankrupt myself trying to fight a multi-millionaire who can afford the best lawyers and drag this out in court. My solution was to find a new job and in doing so I found a job that pays $5 per hour more and with better benefits! Yes I could have fought this in court but would have lost everything in the process!
I am glad you found a new job. I don’t think people are getting the importance of fighting this. What would be the motive of your employer to fight this in court once he was served papers with links telling him that if you had an adverse reaction, that it could finish his company off? Every employer that gets one of these is given an opportunity to save their business. If a person dies from this vaccine, from an employer forcing it on them, this could finish the business. Just one. Imagine of multiple people do.
Hello! I just got a job in Ottawa that requires me to get tested every shift for not getting vaccinated like me as if I have to spend more money on healthy eating just to get immune. My anxiety level would go up to the next level if I were forced to isolate (I live with a roommate). I am afraid that if I submit the notice of liability to the employer by email, HR in particular, he or she will not accept it. I don’t know what to do.

On Aug 13, the PM announced mandatory vaccines for all federal workers, civil servants, public workers etc including crown corporations or one could risk losing their job. All the info on the site is excellent but is based on no federal mandated rules. This is now a game changer. How can the government tell a person what to do with their body? Sure Dr. Tam will say “I’m the expert, it’s safe” and the government will base their info on her comments. the medical exemptions are if you have had an allergic reaction to any vaccine- such as even the flu shot. I have been in that position and almost died. I would be one of those exempted.
I’m actually wondering under what authority they are mandating vaccines? You have to have a law or policy in my experience. And I’m an HR manager. Otherwise you are liable. There is no law at the moment. There is no public health order either as far as I know. Even if the employer creates a policy they changing the employment contract and that’s not so easily done with existing employees. I think what’s happening right now is a lot of hot air. I’m resistant to recreate policy only because when you do as an employer you invite more liability. For David: My daughter is an international riding athlete and usually goes to Florida to train & show for the winter. We trailer our own horses down, but last year they would not accept anyone hauling but commercial haulers. Is there anything that we can show at the border Canada to Us to help us pass? Approval or lack thereof makes no difference in it being legal to coerce or bully someone into taking it. If it says experimental, take that word out.
Anyway a notice of liability could be issued to a business who refuses you based on no proof of vaccination (passport). I live in BC and passports are now being required by our province.

My husband’s union (University, where he has been a professor for 30 years) sent out a directive last Friday (Aug. 21) that, as they headed into a new collective agreement with the University, they were going to mandate vaccination for all union members, in spite of the University stating that this presented serious legal problems. They had such a kick back response of “ABSOLUTEYLY NO’ that they retracted their intended position. On the top of pg 5, on the Notice of Liability to Employers, it says: “Vaccination is voluntary in Canada. The federal and provincial governments have made it clear that getting the COVID-19 injections will not be mandatory.” As you know, legislation has now changed. Will the template be updated to reflect new legislation.

We have received but cannot accept your notice of liability regarding vaccination. If a vaccine clinic is established in the school, it will be a decision of the local health unit, not the school board or the school.
Vaccines are offered by regulated health professionals, not the school board or its staff. While information regarding public health is communicated to students, school board staff do not provide medical/health advice. The decision whether or not to receive a vaccine is the decision of a capable student and/or the student’s parent/guardian in consultation with a regulated health professional, not school board staff.
Well then, they admit its still a choice, so that is good enough right there.

Having printed out both a form for employer and one for post secondary student, when collating I thought I messed up, however it is the actual form itself.
What I mean is, for point #7 in the employer section it speaks of minors whereas in the student’s it speaks of people under the age of 30.
This should be flipped.

I don’t see a general form we can carry to pull out in hospitals and other places saying what some of these forms here say so that we can be with our loved ones in ER yet _not_ be forced to get vaccinated, for example, right then and there. Just go, and if they ask you for your medical records, you tell them it is none of their business. If they don’t let you in, you sue them. The human rights tribunal has already spoken out on this, and it is illegal to ask someone for their medical records, and discriminate against them for not providing them.
I need help. I am a flight attendant and I received a letter that I must be vaccinated in order to be recalled to work and that if I am not vaccinated until said date that I can take a leave without pay until another said date, after which I will be fired if I am still not vaccinated.

Unfortunately you are not alone in this. Crazy that they would even want to mandate something that has loads of evidence for blood clots!!! Notice of liability is the way to go and whatever you do, DO NOT quit. There are plenty of lawyers that have spoken out about this being coercion, that is not informed consent. I filled out the religious accommodation form from the college on September 3, 2021. Brian Muscat The dean of students has denied me access to my class and to the campus. And has said no to the religious accommodation. As a person interested in fighting for students rights what is my next move? I need help from someone please!!! What should I do? Dear Ms. Reed,
We write further to your request for religious accommodation dated September 3, 2021.
Having carefully considered your submission, we are denying the vaccination exemption request because it does not set out a valid basis for accommodation.
The College’s duty to accommodate an individual’s creed applies when the individual has a belief that:
1. is sincerely, freely and deeply held
2. is integrally linked to a person’s identity, self-definition and fulfilment
3. is a particular and comprehensive, overarching system of belief that governs one’s
conduct and practices
4. addresses ultimate questions of human existence, including ideas about life, purpose,
death, and the existence or non-existence of a Creator and/or a higher or different order
of existence
5. has some “nexus” or connection to an organization or community that professes a
shared system of belief, although the beliefs or practices do not have to be required by such a doctrine.
A qualifying belief is a belief that, “calls for a particular line of conduct, either by being objectively or subjectively obligatory or customary, or by, in general subjectively engendering a personal connection with the divine or with the subject or object of an individual’s spiritual faith.”
You have provided us with a copy of the Liberty Coalition Canada’s “A Christian Declaration of Freedom from Vaccination Coercion” as well as a letter entitled “Demand for Accommodation from Mandatory COVID Vaccination” authored by Counsel for the Liberty Coalition Canada.
You have not provided us with any statements that could support a finding that you have a deeply held religious belief that precludes you from being vaccinated. You are of Christian faith, though many who share such a faith are very open to vaccination. Relying on the Liberty Coalition Canada Declaration and supporting documentation from Counsel for the Liberty Coalition Canada – both of which are pre-prepared, principled objections to vaccination mandates based primarily on libertarian principles – does not establish a sincere and genuine religious belief that precludes you from becoming vaccinated.
We have established our vaccination policy due to an important concern about student and employee safety during a global pandemic, particularly as cases of the Delta variant begin to surgein Ontario. We welcome you to attend campus, but to do so you must comply with the College’s vaccination policy.

As far as employers demanding vaccinations/vax passports is concerned, it is ALSO critical to note the Canada Labour Code https://www.parl.ca/DocumentViewer/en/42-1/bill/s-201/royal-assent, which states:
(4) No employer shall dismiss, suspend, lay off or demote an employee, impose a financial or other penalty on an employee, or refuse to pay an employee remuneration in respect of any period that the employee would, but for the exercise of the employee’s rights under this Division, have worked, or take any disciplinary action against or threaten to take any such action against an employee
(a) because the employee refused a request by the employer to undergo a genetic test;
(b) because the employee refused to disclose the results of a genetic test; or
(c) on the basis of the results of a genetic test undergone by the employee.
*and*
Every person who contravenes any of sections 3 to 5 is guilty of an offence and is liable
(a) on conviction on indictment, to a fine not exceeding $1,000,000 or to imprisonment for a term not exceeding five years, or to both; or
(b) on summary conviction, to a fine not exceeding $300,000 or to imprisonment for a term not exceeding twelve months, or to both.
Remember a company can still fire you after you take the Jab …..so why put yourself in a compromising situation …..make sure to serve them Notice right away and then contact your Human Rights to advocate for you and lead you to a Lawyer who will take your case on ….these forms are tools which is well prepared for you to get the job done and you do not need to take the Jab ….I have lost friends and family after the 1st Jab don’t do it you will regret
Hello! Our hockey academy is education based hockey. Kids in their own bubbles (teams) are practicing in the morning and then go to gym. Our academy switched providers from Hollyburn country club who is mandated vaccine passport entry/use facilities on 12+ kids and now we are using privately operated gym who is also mandated. Our sports program is a part of education and therefore essential. How can i serve them a letter of liability? . I don’t want my 12 year old kid get a second dose. We were already coerced to first one. And by October 24the they demand second one, no refunds be given or whatsoever. Why healthy kids can not use gym without passport which is a part of sport and school? (This is all in one package hockey/school).
How can i get to private country clubs to let kids in without restrictions (academy sold us a package of usage country club, but then switched to public ice rink and private gym)

Hi Alina, Unfortunately the new target age group is 12 -30 as they are the least vaccinated age group and therefore, meeting the most restrictions as health clubs, schools and such. We always recommend resisting pressure to get the shot, your son has already taken the first vaccine dose, so it is a tough argument to say that he is exempt for medical reasons and therefore being discriminated against, unless of course he experienced a severe adverse reaction to the first dose. I would say that your best course of action would be serve them with a Notice of Liability form and that the data you have reviewed indicates that covid vaccination is detrimental to people in his age group and hope they reconsider. If not, they should be providing refunds as they changed the rules of the contract so to speak. Although, I don’t agree with any of this it seems as you have appealed to the parties involved, to no avail. The next step would be to serve them with a discrimination complaint, however, as stated previously, hard to defend the first shot and how not doing the second would be detrimental. To serve them you complete the form at awakecanada.org/say-no. I suppose as a last ditch effort you could have a consultation with a human rights/constitutional lawyer. I have issued my child’s principal, teachers, and school board with a notice of liability for the mask and vax. Just recently the union for this school district stated that various staff within the school district may have received various legal forms from parents – a notice of liability- and that the staff can safely throw those forms away that they are not liable for anything that happens to any student under these Notices. Is this true? Anyone I gave the Notice of Liability is 100% responsible if they choose not to follow the Notice Correct?
Yes you are correct, they can throw them away all they like, however if something were to happen to your child they are not less culpable, just as if they were injured on the playground and so on. Make note of date and name of person served, I would suggest you make two copies and note the persons name and reaction to receipt of the NOL. Keep up the good fight!
Are there any legal forms or routes for a parent to take regarding joint custody and vaccine for child age 12-18? Meaning one parent is insisting on the vaccine for the child and the other is opposed to it

Serve them to your employer, which would be the hospital HR department. Get a lot of you to do this at the same time.

I am looking for a form to give my Dr to make him on notice of liability if he is not willing to write me and my wife and kids a medical exemption. Written as such that if we are forced to take to jab and have an adverse reaction that he would be personally liable for not writing the exemption for health or conscience reasons. He is well aware that our son had an adverse reaction 6 years ago and developed SPD. Through his hair analysis we determined that he had heavy metal poisoning and looking at the pamphlet for meningococcal conjugate jab, first ingredient was aluminum and aluminum was off the charts in his toxicity report. He has been exept from school requirements ever since but this new mandate sh#t requires a note from DR. Any help will be appreciated. Ty
you can download the pdf and with a pdf writer you can adjust for the DR, it is a great idea as if the doctors are going to be complicit in this they should have some responsibility.

The employment liability one. It is not directed at them, but a tool the union can use to defend its members. If they are not supporting the members, then this will be more about who to sue after you lose your job. These mandates are illegal, and liablity falls on the employer. Serve your employer and bypass the union if you have too. If the union does not step up to defend you, then you need to do it yourself.
I am an Acupuncturist and I pay a regulatory body to keep my license in good standing. This body (College) has not enforced it yet, but likely planning to require us to be double jabbed in order to be licensed in BC. Most of us are self-employed, but if we cannot hold a license we cannot get liability insurance and thus, cannot retain our livelihood and practice.
I see the Employer Vaccine Notice of Liability documents, do you have anything I could send to my regulatory body?

My suggestion would be if this happens, forget about your regulatory body, and continue practicing without paying the dues. #unitednoncompliance. As far as liability goes, all you would need to do is ADVERTISE you as someone who is standing up for your rights, and as a result get flooded with business from people that will ONLY see people like you. Then make a requirement of service from you, for every client to sign a release of liability to you just like a company in adventure sports like parachuting, or white water rafting. People sign these all the time, and people are also screaming for medical professionals to walk away from their boards and make their practicers private. We are the responsible ones that understand the risk of treatment, or any medical procedure, and we want to keep these decisions in our hands, not the governments.

In last August the HR manager sent all staff an email stating that all employees will have to be fully vaccinated soon or face termination. I emailed the notice of liability form in early September to Management/HR and never had any replies yet. I’m still employed but I still have a feeling that they’ll be enforcing a vaccine mandate soon. When that time comes, any recommendations for Lawyers in BC? Thanks
A lot of extensions have come in multiple provinces, and occupations. The pushback with these are working.
The day after my previous comment on November 5th, all staff received an email stating that there’s now a Mandatory Vaccine Policy. All staff must be fully vaccinated by December 20th or be placed on unpaid leave of absence. Should I still attempt to show up for work on December 20th (un-vaccinated)? Will I be eligible for any type of severance pay right away or would that be a long dragged out process in the court system? Thank you all Awake Canada team members.
These dates keep on getting bumped. Hold the line, and be very vocal before this date. Find other people in your workplace that also feel the same way and make your voices united be heard.
Will any of these work for Cross border truck drivers. My husband and several family members are being told they WILL have to be double vaxxed by JANUARY and that means the first one must be taken this week or next in order to not lose their jobs. Hello. My comment above about cross border truck drivers is different in that the Canadian based company says they have no control over the US border patrol and rules for entering the United States even as an essential worker they will be required to be vaccinated by January. How do we serve notices of liability to US border when we are Canadian? Or is that even possible? I just don’t know what to do. If anyone can please direct me to the resources and people to address or stop this. My husband is considering taking the vaccine because he doesn’t know any other job. Hi I’m encouraged to be here and read the support and determination for us to remain free in this country, Canada. I sent a NOL to my employer’s Board of Directors, to each individual. I’ve had no response and I only work casual to replace a worker who has now gone on stress leave. I was asked to sign a letter agreeing to the Unpaid Leave for 60 days which is getting close I’m not sure what to do next.

It is hard to blame the employers when you see how much they are being manipulated by the government, they have a false sense of security that the government will back them up, which is not the case. As a 25 year HR person, I am shocked at what is being counted as acceptable, when I know from my experience would have never been accepted previously!!!

Leslie, recently lost her mother shortly after her second jab, is not able to help with this right now.
My daughter is a student at university of Waterloo and her application for religious accommodation was just rejected. She has been asked to provide a proof of vaccination by Dec. 20 or she will loose her student status. I would appreciate a feedback that might help putting our efforts in the right direction. I checked Constitutional Rights Centre web site and could not find anything about class action law suits against student mandates. This class action was mentioned in one of replies above.
