First you must understand that there is no legal ways anyone can force you to get vaccinated to keep your job. This is a massive liability issue for the business. This also goes for discriminating against people coming into your place of business, over masks, vaccination status, or testing. Lawyers are starting to have a field day with this people. As of right now I haven’t lost my job but it’s very difficult because my job is self-employed but the facility that I Kochen is listed as a recreational facility so you can’t enter without a vaccine now there’s a fine line because it says exception youth activities as of right now I have one community center that will not allow me but another one where I am free to coach so is this a lawsuit that I bring against my township for not allowing the community center to allow me in because of my job being self-employed? I don’t know where this is, but the legal advice in Ontario, is do not submit to testing, or vaccination, and make them force you out of the school, and record everything you can. This is unconstitutional in Canada or the US, and will be defeated in the courts.

Unfortunately, there are few worse than Trudeau or Biden. The same principle will work, as your constitution is actually even stronger than ours, but you will need to look for notice of liability forms for your State.
Is there a lawyer/ law firm that is able and willing defend postal workers and go against Canada Post? There are hundreds of us who will stand firm and not receive the jab.

Serve your union leader the notice of liability forms found on our site. Make them assume liability if they are asking you to take something, then if they did, (which they won’t) still say no. Hi David. I work for Revenue Canada in Winnipeg, Manitoba. Permanent employee. Today, we were told we have until Nov 26th to provide vax proof. If unwilling, we will be put on indefinite unpaid LOA. I can say no thank you but I work from home. They will suspend all our access and leave us no option. We can’t sue until they actually fire us. Our union is sitting on their hands. Financially, this is not feasible for me. I believe many want to fight, including myself, but they are leaving us in neutral territory by not firing us.

I am not aware of any in Nova Scotia. I would if I was you, start searching for a lawyer that would like a class action lawsuit. I can certainly direct members of this site to any lawyers website that has a form for signing up for one. I need people in each province to do the leg work and find a lawyer that will do this.

From what I’m hearing they will be laying people off if you don’t show proof along with a severance package to let you go. So in this case who do you go after the union ? Please consult a lawyer. Businesses and corporations cannot intervene in employees medical business. This is law in Canada, and everything is a bluff to get more people vaccinated. This is complex question, as your contract, vocation and labour standards are unknown to me. I preface my OPINION with; I am not a lawyer nor do I know the ins and outs of your collective agreement. In my opinion, first off this a letter surrounding ON labour relations laws, so I would check with local labour relations board for informations such as this. Secondly as the article suggests the employer must be sure when they implement a NEW policy it has to be in alignment with your current collective agreement. An employment contract or collective agreement can not be arbitrarily changed solely at the impetus of the Employer, it has to be reasonable and justified. For example if they want to implement testing so you do not infect food stuffs but you do not come in contact with food or consumables, and you simply move pallets around and prepare for shipping, requiring this is not reasonable. Also in my opinion, rapid testing such as PCR is being discontinued in December, there are other means of testing that are equally if not superior to PCR, such as the gargle test, if a person is sick the evidence is contained in in salvia and mucus membranes therefore any testing should be adequate.
I strongly recommend discussion with your shop steward to get details on this change, the union works for you and should address concerns with testing. If you are not satisfied with or received an appropriate resolution you can consider seeking out counsel with Labour Relations Board here in BC.
Suggestion: Everyone voting this election, tic off your choice with a black marker (bring your own). You’ll be offered a pencil. All a corrupt system (I’m not suggesting that’s the case here in Canada of course) would have to do if they wished to change your vote would be to mark a different choice with ‘a black marker’, and that’s what would be picked up.

I work for a major Canadian transportation company (federally regulated industry) and they’re mandating all of their employees to be double vaccinated by November or face suspension without pay and possible termination. We’re ordered to provide our vaccination status by the end of September as well. I’ve been able to gather a handful of people together (and still growing, hopefully up to 15 by next week) that don’t agree to this, but several are fearful of losing their jobs because they need to provide for their families. Others have accepted that they’ll lose their job because they feel so strongly against the need for this vaccine. I for one have worked there for 2 decades with a great pension and benefits, but my instincts and very fibers of my being are telling me not to take this vaccine. But I too am afraid to lose a very well paying job that provides for my family.
Our group needs help. We’re trying to find a lawyer that would at least listen to our case, or join another lawsuit that is looking for more participants. Our group is spread across Canada but we are united by our feelings and thoughts around the vaccine and these mandates.

Your problem is everywhere, it is very frustrating. There are many good lawyers out there, one company that I recommend is Samfiru Tumarkin LLP. They have offices in Vancouver and Toronto. They are primarily employment and disability benefit lawyers. I recommend that you call them, explain the situation and an intake person will call you to get further details. They may set up a zoom meeting for members to join in a zoom call. Likely they will charge a consultation fee so it will be more cost effective if a few of you chip in. Whatever you do, DO NOT quit your jobs, if you are terminated because the employer changed the employment contract that is grounds for constructive dismissal. Mr. Tumarkin recently said on the news that employers could face up to two years severance and that many employers have no idea the trouble they could face in coercing employees to take a medical procedure with the threat of termination.
It is troubling times and our thoughts are with you and your colleagues, please make sure you all vote in the federal election. Hello, David , I recently watched the video by Dr Rashid Buttar about what Trudeau wants to do to the unvaxxed. He states that if we do not get the shot that they will take our possessions , cease our bank accounts , cease our property and put us in isolations camps indefinitely and never be able to get our possessions and property back . How true is this and is it illegal for them to be able to do that and could it really happen? This has me very worried .
it is all a part of agenda 21 and so on. It has us all worried. Although there is nothing official out there saying that, but it is early days. It has got me wondering if I should sell my possessions and flee the country. It is hard to know what moves to make, certainly there is a lot of hatred out there for the “unclean” so I am worried as well. It is not legal for them to do this (yet) but they have done it before, after Pearl harbour, the BC government rounded up all the Japanese immigrants, took their homes and placed them in internment camps. Serve your union leader the notice of liability forms found on our site. Make them assume liability if they are asking you to take something, then if they did, (which they won’t) still say no. This is complex question, as your contract, vocation and labour standards are unknown to me. I preface my OPINION with; I am not a lawyer nor do I know the ins and outs of your collective agreement. In my opinion, first off this a letter surrounding ON labour relations laws, so I would check with local labour relations board for informations such as this. Secondly as the article suggests the employer must be sure when they implement a NEW policy it has to be in alignment with your current collective agreement. An employment contract or collective agreement can not be arbitrarily changed solely at the impetus of the Employer, it has to be reasonable and justified. For example if they want to implement testing so you do not infect food stuffs but you do not come in contact with food or consumables, and you simply move pallets around and prepare for shipping, requiring this is not reasonable. Also in my opinion, rapid testing such as PCR is being discontinued in December, there are other means of testing that are equally if not superior to PCR, such as the gargle test, if a person is sick the evidence is contained in in salvia and mucus membranes therefore any testing should be adequate.
I strongly recommend discussion with your shop steward to get details on this change, the union works for you and should address concerns with testing. If you are not satisfied with or received an appropriate resolution you can consider seeking out counsel with Labour Relations Board here in BC.

I work for a major Canadian transportation company (federally regulated industry) and they’re mandating all of their employees to be double vaccinated by November or face suspension without pay and possible termination. We’re ordered to provide our vaccination status by the end of September as well. I’ve been able to gather a handful of people together (and still growing, hopefully up to 15 by next week) that don’t agree to this, but several are fearful of losing their jobs because they need to provide for their families. Others have accepted that they’ll lose their job because they feel so strongly against the need for this vaccine. I for one have worked there for 2 decades with a great pension and benefits, but my instincts and very fibers of my being are telling me not to take this vaccine. But I too am afraid to lose a very well paying job that provides for my family.
Our group needs help. We’re trying to find a lawyer that would at least listen to our case, or join another lawsuit that is looking for more participants. Our group is spread across Canada but we are united by our feelings and thoughts around the vaccine and these mandates.

Your problem is everywhere, it is very frustrating. There are many good lawyers out there, one company that I recommend is Samfiru Tumarkin LLP. They have offices in Vancouver and Toronto. They are primarily employment and disability benefit lawyers. I recommend that you call them, explain the situation and an intake person will call you to get further details. They may set up a zoom meeting for members to join in a zoom call. Likely they will charge a consultation fee so it will be more cost effective if a few of you chip in. Whatever you do, DO NOT quit your jobs, if you are terminated because the employer changed the employment contract that is grounds for constructive dismissal. Mr. Tumarkin recently said on the news that employers could face up to two years severance and that many employers have no idea the trouble they could face in coercing employees to take a medical procedure with the threat of termination.
It is troubling times and our thoughts are with you and your colleagues, please make sure you all vote in the federal election. My opinion is that the PPC party is the best choice because they BELIEVE in CHOICE. They would abolish all Covid mandates and restore freedom of choice for vaccination. Any one of the big three will continue to break constitutional laws, operate against the Nuremberg Code and take more and more freedoms from us. Hello, David , I recently watched the video by Dr Rashid Buttar about what Trudeau wants to do to the unvaxxed. He states that if we do not get the shot that they will take our possessions , cease our bank accounts , cease our property and put us in isolations camps indefinitely and never be able to get our possessions and property back . How true is this and is it illegal for them to be able to do that and could it really happen? This has me very worried .

it is all a part of agenda 21 and so on. It has us all worried. Although there is nothing official out there saying that, but it is early days. It has got me wondering if I should sell my possessions and flee the country. It is hard to know what moves to make, certainly there is a lot of hatred out there for the “unclean” so I am worried as well. It is not legal for them to do this (yet) but they have done it before, after Pearl harbour, the BC government rounded up all the Japanese immigrants, took their homes and placed them in internment camps. That was in 1946-47. Any possessions that could not be carried away were seized and sold to pay for the care of the internees. So in essence they paid for their own imprisonment!! Interestingly Pierre Trudeau refused to accept responsibility for this egregious act of cowardice as he didn’t want to be held responsible for a previous governments error in judgement. I think you are right to be worried.

Hi Yvette, you along with many others are facing this unbelievable ACTION! I have to disagree that you are actually being COERCED (aka forced) it is against Nuremburg code, employment law and human rights! It truly is mind boggling that we are at this stage! I’ve sent the following suggestions to others:
1. The only reason this is happening is because people are allowing it too! We need to stand up against this UNLAWFUL action. Who is going to be held responsible in the case that you have an adverse reaction!? Go to the liability form at http://www.awakecanada.org/say-no serve this to your employer.

3. Do NOT quit your job, if they are not allowing you to work then they are firing you. Suspending a person without pay is considered constructive dismissal, basically they are not allowing you to make a living and they are not providing work, therefore, putting you in a position to seek other employment, therefore quitting. If they fire you for not getting the jab then they are acting illegally.
4. In the case of discrimination/firing, contact an employment lawyer in your area to help you with wrongful dismissal. There is absolutely NO WAY this can be allowed to happen. I am an HR person with many years of experience and employers are not allowed to change the employment contract to suit them.
5. If you do not want the jab, do not do it to preserve your job, the truth is that NO job is SAFE from termination. Wouldn’t it be a shame to do something you are against, only to lose your job anyway?
