In this post, I want to help you tactfully refuse vaccines as a requirement for your work. This also will apply to testing.
So if your employer is brazen and ignorant enough not to know the law that they are violating by requesting you to be vaccinated as a term of your employment, first understand, that in Canada this is completely illegal. Knowing this, you can put this issue to rest.
However, if your employer does ask you, or state that if you refuse you will have to submit to testing on a regular basis, there is this law, that also states that it is illegal to require you to test. It is the GNA law of 2017 formerly known as Bill S-201.
Here is a link to it for you to print out and give to your employer.
Now to the nitty gritty.
If your government regulated employers such as airlines, trains, hospitals, and many others goes to implement this, you simply say, you are willing to get the vaccine if they can provide you with the following information.
- Are there any of the vaccines that are approved for clinical use, and if so what are they?
- Can you provide me with a detailed list of adverse reactions, deaths, and other risks of injury that are required in order for you to have informed consent?
- Since the vaccine manufacturers are indemnified from liability if there is injury, death, or long or shorterm adverse reactions, are you willing to accept liability?
This will stop most of them in their tracks.
If they cannot accept all 3 of those terms, you are off the hook, and if they terminate you, there is a slam dunk wrongful dismissal case, and you will be able to sue to the maximum amount you would be eligible set forth by provincial and human rights legislation.
If they do comply with this, (they absolutely will not), you serve them with a notice of liability form from here, and ask them to sign and return to you. Then if they have met all requirements, still decline, and make them fire you. You are still in the rights. But by doing this first, you get to educate your employer, and save all employees from this unlawful discrimination.
The government like everything else they are doing is counting on the ignorance of people to succumb to the bullying, coercion, and unlawful tactics they are using. Stand strong, stop being intimidated by anything, and you will win. But the most important part of this, is to share this EVERYWHERE, so that other people, and employers know their rights so that there is not a big shutting down of big and small businesses as they get sued into bankruptcy, which in all likelihood is the goal of the government in the first place. You will notice that companies like Costco, Superstore, and Retail giants that operate in public settings will not enforce these, because they are illegal, and they know this. This is an attempt to destroy all businesses that compete with them, creating a monopoly that corrupt government officials are getting paid from to do so.

Welcome to tyranny. You fight for your rights. You get a lawyer if needed. You join protests at airports demanding this. I feel pretty soon, we will be protesting at the airports blocking the streets in and out of them. It might be too late for you, but this is the problem. what does the dna law have to do with a pcr test ?
It is GNA, genetic not DNA. Which means any test taking genetic samples from your body must come from consent. If you do not consent, they cannot test you. So refuse this under this act, and if you are continued to be pressed, consult a lawyer, and use this law to protect you from any further testing on you fi you wish not to be tested.

Here is one thought. I have been stuck in the Philippines since May 2020. I can only renew my visitors visa so long. After that when it is unlawful for me to stay in the country, I will let the airline know that they cannot force me to stay in a country against the laws of that nation and that being said, If I have to face a court because I overstayed. I will 1. be naming all owners and agents who prevented my departure as co-defendants and accessories to the breach of the immigration laws and 2. Suing the airline and any agents who prevented my departure.

I’m a gov employee it was announced that if a person is not vaxed they will need to be tested once, twice maybe 3 times a week for covid by Ont provincial doctor. There are a number of tests that one can take, such as serological (blood test) or gargle test.
I am inclined to refuse them all as you are right, it is discriminatory and unlawful. As an HR person, it is widely understood that laws dictate that employers, educational institutions, shop keepers and the like have no right to access or dictate your health choices, with the exception of illegal substances and then only in matters of safety such as mining, pilots etc. In those cases the employee has agreed to those terms of work. No one can simply just change an employment contract without risk of litigation which is why this announcement is astonishing!
The airline here in the Philippines will not accept a saliva test, even though the red cross provides the service for a moderate fee and it is acceptable for all travel “within” the country. Not that the PCR test detects anything real whether they jab something up against your blood – brain barrier or spit on a stick.

I ran out July 28th to get 1st shot im in Quebec too. 2 weeks later had numb fingers, tingle left leg, nueropathy all over body, then the sore joints kicked in hard for 3 days. I went to ER day of symptoms. He took sooo much blood and it is all perfection. Inhad an MRI brain today and it is clear. I wrote to health canada asking ehat do i do? ER doc didn’t reccomend taking second shot yet, due tommorow and i still have symptoms. I cut out all dairy, sugar, processed food, wine, abd upped my VITAMINS B, D, omegas, and berries. It helped a little but im still at a loss.

How does it work in this situation? My wife is working for her company from home. Our neighborhood is having a 2-day planned power outage soon for upgrades. Since the power will be off, she cannot do her work from home. She requested to work for those two days in the office and informed her boss. Months ago, this was not an issue. But now since she is not vaccinated and rest of her staff is, it is now an issue. They will not allow her in the office and call it a safe zone. They suggest she take a 2-day vacation instead, and the resume working from home. She will get paid, but I find this unjust as well, by not allowing her in the office do do her job. What kind of action shall she take in this case?

I would like to offer you advice, but I am not a lawyer, but if the office is paying her for not working, I don’t think there is anything you can or shoujld do. It sounds like a workplace accomodation to me, where they accept fault of their own policies.

I am not from Canada. In my neck of the woods, I expect them to get security to block your entry pass/swipe card. Then security will deny you access and after x days of no show for work, you get fired. The government ministers are themselves not law abiding and the police are an authority upon themselves. The judiciary are nothing to shout about either. At least you and New Zealand have some rule of law. What does a pilot do if they fly overseas and the destination refuses entry for unvaccinated aircrew?

I hear what you are saying however, in unionized environments where the UNION is insisting on vaccines, you may get fired and the union DOES NOT need to represent you. Not only are they not obligated to defend you, there is no recourse if they don’t. UNIONS are the cancer of this country.
Great info. Most companies.. especially small ones will likely back down. I work for a big law firm that just mandated vaccines. and I will not be allowed into the office without an exemption… if approved, and then so, will need to take rapid tests.

I cannot give legal advice, but this seems ridiculous that a law firm would do this. Either you are someone trolling for legal advice from someone you know is not a lawyer, or your law firm lawyers are complete imbeciles.
I am an international teacher (Canadian). My school just mandated vaccines which I refused so I asked to be released from my contract. I will be moving back to Canada temporarily until this insanity is over. Leaving a job and country I absolutely love but I love my freedom of choice and my body more.

Of course we do. Just because it is approved, doesn’t mean they can make you take anything. Mandating vaccines is illegal in Canada. That’s why they are just going to make things uncomfortable for those that won’t do it. But judging by the amount of stuff coming out, we will defeat this for sure. Just don’t know when. I don’t think this genetic testing legislation will help us here? They define genetic test as: “genetic test, in relation to an employee, means a test that analyzes the employee’s DNA, RNA or chromosomes for purposes such as the prediction of disease or vertical transmission risks, or monitoring, diagnosis or prognosis”
The PCR tests for viral RNA fragments, not human genome components, so I don’t think it is a genetic test in the context of this legislation.

I work in a hospital and I am being told that I will have to get jabbed or have regular antigen testing. As an employee of a hospital, we were required to get a TB skin test before employment and every several years, we are required to get another one. How can I legally refuse antigen testing, but not a TB skin test? I wouldn’t have been hired if I didn’t have a negative TB skin test.
Work the angle on asymptomatic people cannot virally spread disease. If you have no symptoms, you are not at risk of spreading disease. The evidence of this is abundant. It is abhorrent that medical institutions are not even aware of this, or have been somehow medically retarded from the brainwashing.
What happens in the event of a “covid outbreak” at a place of work? (Big construction site) and several people have tested positive for delta covid. They are doing contact tracing and say “I need to do rapid testing or quarantine for 2 weeks if I refuse testing”? I will refuse testing and present them with the GNA act… but, am I entitled to 2 weeks of pay (hourly worker)?
I cannot tell you about what you are entitled too as far as money, but you certainly have the rights to refuse testing, and/or quarantining. If they do not give any other accomodation, they are liable. Consult a lawyer to find out for what. Most lawyers consult fee, is not that much, and you can even pay a little extra to get a letter explicitly instructing the employer that they are liable for their actions and that you will move forward with a lawsuit.
Hi David, thanks for the work you are doing. I work in a long- term care setting. I have been told that I will now be required to have a rapid-test done prior to each shift that I work. Is this considered a type of genetic testing or just the nasopharyngeal PCR one.
Over the entire pandemic, I have submitted to twelve tests already and have never had any symptoms to justify these. As the RN on duty, I often administer the rapid test when asked by my co-workers. Please let me know as there is lots of pressure to comply and I am resolved 100% that I will not get jabbed.
This is most certainly a genetic test. Exercise your rights. Also find all the information and videos about asymptomatic people do not spread viruses. This negates mask wearing and testing. Even the CDC and WHO have come out and said only sick people should be tested. If you do not feel sick, you cannot spread sickness, even if you are, but pre-symptomatic.
What do you think about keeping your vaccine status to yourself rather than say you are not vaccinated, and instead just say that there are millions of vaccinated Ontarians / Canadians who have a strong belief (creed) hat mandating anyone to put any specific medicine into their body is unethical and very wrong, therefore will not be providing proof of vaccination. Indicate these vaccinated people also strongly oppose discrimination against those who are not vaccinated. Ask them what these vaccinated people should do – should they be tested regularly despite being vaccinated because they do not provide proof? Perhaps ask them why all employees are not required to be tested regularly since we know that vaccinated people are catching and passing the virus along. Would this approach keep your status to yourself and remove the ability for anyone to know whether people being tested are vaccinated or not? Would it take the focus off whether or not you are vaccinated to whether or not anyone should be required to provide proof of it or whether or not anyone should be discriminated against? I am sure there are millions of people who disagree with this charter violation whether vaccinated or not.

So Edmonton police service, Alberta emailed every sworn & civilian employee today ( 30 aug) demanding their vaccination status. This is private information and this coercion & blackmail must stop.

I am in need of some advice.
I am a nursing student and recently got a email from Edmonton Norquest college (where I am an online distance student) stating that as time comes from clinicals and placement that it is mandatory for me to be vaccinated in order to be placed at facilities and to do the hours needed to graduate from nursing school. I have no idea what to do and I refuse to do the vaccination!

I can’t thank you enough for this video. I am in BC and have been under immense stress. My architecture firm has followed along with the province and will be ‘requiring’ proof of vaccination to enter the office starting Sept.13th. Even worse, all of the politicization of science and healthcare is tearing apart my family (though I’ve been told I am the problem…). Mandatory COVID-19 vaccine for all employees in Canada effective November 1, 2021
As we move through another phase of the pandemic, COVID-19 and its variants are causing an upsurge in new cases across our network. These unprecedented circumstances require us to act decisively to protect ourselves and others from harm. Your safety is our number one priority.
On August 13, 2021, the Government of Canada announced that it will require employees of all federally regulated transportation companies to be vaccinated by the end of October. CN is committed to show leadership in the fight against COVID-19 in an effort to protect the health and safety of our employees, our customers, the communities in which we operate and to support the global economy.
Effective November 1, 2021, we will require all CN employees in Canada to be fully vaccinated against COVID-19 as a condition of employment. The Company’s vaccination mandate will extend to employees of our wholly owned subsidiaries as well as CN’s contractors, consultants, agents and suppliers and anyone who accesses CN properties in Canada. CN will consider, on an individual basis, requests from employees for exemptions based on legitimate medical conditions or established, personally held religion that prohibit vaccination.
If you haven’t already received your COVID-19 vaccination, we urge you to do so as soon as possible. By September 24, 2021 all employees must confirm their vaccination status via the CN Vaccine Tracker or through CN Occupational Health Services if you do not have access to the vaccine tracker. You will be required to upload proof that you have been fully vaccinated with a vaccine approved by the Public Health Authorities in your jurisdiction.

None of this is legal, so it will be interesting to see if it actually happens. Hold steadfast, do not get the jab to save your job.
We were excited and relieved to see and hear the first parts of this video. It gave us confidence and encouraged us in staying above the fear that drives so many people.

Hi, I have a number of friends and family members who are being affected by the City of Edmonton and Alberta Health Services mandates. They are both saying that they will not fire you if you don’t comply but instead will put you on “leave without pay”. This is how they are trying to get around the wrongful dismissal liability but it still leaves the employee without income until they comply with the policy. Do you have any suggestions for how to handle this?
HI Jayla, They cannot do this it is a term that we use in HR – its called constructive dismissal. When you make it impossible for an employee to earn a living, you are forcing them to quit. Foolishly businesses have a false sense of security as they believe they have the backing of the laws. This is NOT true, they are in grave jeopardy for being liable for hundreds of thousands of dollars. Here are my recommendations:
1. the only reason this is happening is because people are allowing it too! we need to stand up against this UNLAWFUL action.
2. Do NOT quit your job, if they are not allowing you to work then they are firing you. If they fire you for not getting the jab then they are acting illegally.
3. Read this and make sure you understand, then send to your employer: https://laws-lois.justice.gc.ca/eng/acts/G-2.5/page-1.html
4. In the case of discrimination/firing, contact an employment lawyer in your area to help you with wrongful dismissal. There is absolutely NO WAY this can be allowed to happen. I am an HR person with many years of experience and employers are not allowed to change the employment contract to suit them.
5. If you do not want the jab, do not do it to preserve your job, the truth is that NO job is SAFE from termination. wouldn’t it be a shame to do something you are against, only to lose your job anyway?

I work for the government of Ontario and I am at the point where the OPS is asking for me to attest that I am vaccinated or not. It needs to be entered into our online employment system by October 12. I believe it is illegal to ask for private medical information but I wanted to know what I should consider before this deadline. Failure to comply results in the treat of being put on unpaid leave or eventual dismissal. It is a unionized positioned. Thanks for any info
Hi Rick, As I have said so many times before, it is mind boggling as most of this is against employment law, human rights and privacy laws. For example putting someone on unpaid leave can be construed as constructive dismissal. Asking someone for their medical status is STILL unlawful in Canada.

In seek of advice from a lawyer in the lower mainland, British Columbia.
Employer stated today, that we must ALL have the first dose by oct.29th, and second dose by dec.10th. “Any employee who is unable to be vaccinated due to a valid and authorized medical reason or for another protected ground under the Canadian Human Rights Act or Code will be reasonably accommodated. Employees who require accommodation on the basis of a protected ground will be required to undergo mandatory COVID-19 rapid testing, with Health Canada approved rapid antigen testing, twice weekly.”
